ДЕРЖАВНЕ РЕГУЛЮВАННЯ ІНВЕСТИЦІЙНО-БУДІВЕЛЬНИХ ПРОЕКТІВ: ПОШУК ЕФЕКТИВНИХ ІНСТРУМЕНТІВ

У сфері регулювання будівництва України давно назріло ряд проблем, про які говорять багато фахівців. Здебільшого міста забудовуються не за визначеними правилами. Наявні пам'ятники історії і архітектури руйнуються попри чинні закони щодо їх охорони, ціни в будівництві не обґрунтовані, будівлі не відповідають проектам, а проекти – нормативним і технічним вимогам. Експлуатація будівель, побудованих на основі критеріїв максимізації прибутку будівельників, створює численні проблеми для кінцевих споживачів об'єктів. Аналізу можливих шляхів вирішення цих проблем присвячено дане дослідження. Розглянуто провідні європейські інструменти і практики регулювання в будівництві, дано висновок про перспективи їх застосування в Україні. Запропоновано механізми підвищення ефективності державного регулювання будівельної галузі України.

В области регулирования строительства Украины давно назрел ряд проблем, о которых говорят многие специалисты. В большинстве случаев города застраиваются не по установленным правилам. Существующие памятники истории и архитектуры рушатся, несмотря на принятые законы об их охране, цены в строительстве не обоснованы, здания не соответствуют проектам, а проекты – нормативным и техническим требованиям. Эксплуатация зданий, построенных на основе критериев максимизации прибыли строителей, создает многочисленные проблемы для конечных потребителей объектов. С целью возможных путей решения этих проблем, рассмотрены ведущие европейские инструменты и практики регулирования в строительстве, дано заключение о перспективах их применения в Украине. Предложены механизмы повышения эффективности государственного регулирования строительной отрасли Украины.

In Ukraine the construction area is long overdue regulation of a number of problems, mentioned by many experts. In most cases, the city was built not by the rules, the existing historical and architectural monuments crumble in spite of good laws for their protection, construction prices are not justified, the building does not comply with the projects, and projects – with regulatory and technical requirements. Buildings constructed on the basis of the criteria of maximizing profit builders, lays a burden on the shoulders of end-user facilities. Analysis of possible ways of solving these problems is devoted to the study. Considered Europe's leading tools and management practices in construction, given the conclusion about the prospects of their application in Ukraine. Proposed mechanisms to improve the effectiveness of state regulation of the construction industry of the country, such as the creation of an effective law enforcement system and norms, free of corruption and lobbying of certain interest; informing makers major investment decisions in the construction, why it is important to comply with the mandatory requirements – local traditional or progressive, European; increasing "transparency" of licensing and the negotiation procedures in the field of construction and public accountability in the field of construction.
